Harvey Weinstein faces rape lawsuit from woman who testified last year

A woman who testified against Harvey Weinstein in December 2022 has now filed a civil lawsuit accusing him of rape.

The European model, who has been identified as Jane Doe #1 in court proceedings, filed the suit on Thursday two months after her testimony led to the disgraced Hollywood producer’s second rape conviction.

She has alleged that he raped and sexually assaulted her in February 2013 after barging into her hotel room at the Mr. C, while she hadn’t previously joined the dozens of women who had sued him for sexual harassment or assault.

Two years ago, a bankruptcy court approved a settlement which led to a payout from insurance funds resulting in $17 million going to more than 50 accusers.

In the new lawsuit, which has been filed in LA Superior Court, the 70 year old has been accused of sexual battery, false imprisonment and intentional infliction of emotional distress.

The suit is looking for compensation for physical and mental pain and suffering, loss of earnings, and the cost of medical and psychological treatment.

Last year, Jane Doe #1 was one of four women at the centre of Weinstein’s Los Angeles trial when the jury convicted the producer of three charges, with all three being related to Jane Doe #1’s allegations.

Weinstein is currently serving a 23-year sentence on his conviction on sexual assault and rape charges in New York in 2020.

Sentencing for the LA case is scheduled to take place on February 23, with prosecutors calling on Judge Lisa B. Lench to hand him the maximum 24 years to run consecutively with the previous NY sentence.

Meanwhile, Weinstein’s lawyers are calling for a new trial as they argue at least two jurors would not have voted to convict him in light of certain evidence excluded from the trial.

His spokesman Juda Englemayer said: ‘Harvey has always denied the allegations.’

He added: ‘Crucial evidence that could have exonerated Mr. Weinstein … was deemed unnecessary by the court for the jury to hear or know about these facts.’
